Videos, comments, profile details and messages uploaded by users are not journalistic or editorial offerings of the provider. The persons posting them are themselves responsible for them; the provider merely stores them on behalf of those persons (hosting within the meaning of Art. 6 DSA).

7. EU dispute resolution and consumer dispute resolution

The online dispute resolution platform (ODR platform) operated by the European Commission ceased operations on 20 July 2025. Regulation (EU) No 524/2013 was repealed by Regulation (EU) 2024/3228; there has since been no obligation to link to the ODR platform, and a link is therefore deliberately not provided.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz, VSBG) (§ 36 (1) no. 1 VSBG). The board that would otherwise be competent is the Universalschlichtungsstelle des Bundes at Zentrum für Schlichtung e. V., Straßburger Straße 8, 77694 Kehl.

We always endeavour to resolve disagreements directly and amicably. In such a case, please first contact info@offline-events.de. For complaints against content moderation decisions, the internal complaint handling procedure described in the terms of use applies in addition; the possibility of turning to a certified out-of-court dispute settlement body pursuant to Art. 21 DSA remains unaffected.

8. Liability for content

We are responsible for our own content on these pages pursuant to § 7 (1) DDG and the general laws. As the provider of a hosting service, however, we are not obliged to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity (Art. 8 DSA, § 7 (2) DDG). Liability for user-generated content arises pursuant to Art. 6 DSA only from the point in time at which we obtain actual knowledge of illegal information and do not act expeditiously to remove the content or to disable access to it.

Obligations to remove or block the use of information under the general laws remain unaffected. We accept notices of possible legal infringements at info@offline-events.de as well as via the reporting function in the app, and process them in accordance with the notice and action mechanism provided for in Art. 16 DSA.

9. Liability for links

Our offering may contain links to external third-party websites over whose content we have no influence. No guarantee can be assumed for this third-party content; the respective provider or operator of the linked pages is always responsible for it. The linked pages were checked for possible legal infringements at the time of linking; illegal content was not identifiable at that time. Permanent monitoring of the content of the linked pages is not reasonable without concrete indications of an infringement. If we become aware of infringements, we will remove such links without undue delay.

10. Copyright

The content created by the provider on this website and in the app, in particular texts, design, source code, logo and the word mark "shiver", is subject to German copyright law. Reproduction, adaptation, distribution and any kind of exploitation outside the limits of copyright law require the prior written consent of Zest UG (haftungsbeschränkt). Downloads and copies of this page are permitted for private, non-commercial use only.

The copyrights in the videos, images and texts uploaded by users remain with the respective authors. The provider receives only the rights of use required to operate the platform, as set out in the terms of use. Should you become aware of an infringement of your copyright, we ask you to notify us accordingly; upon knowledge of infringements we will remove the affected content without undue delay.

Point of contact for authorities (Art. 11 DSA)

Via the above e-mail address, the authorities of the Member States, the European Commission and the European Board for Digital Services can communicate with us directly and by electronic means. Orders pursuant to Art. 9 and Art. 10 DSA are to be addressed to this address. No legal representative pursuant to Art. 13 DSA needs to be designated, as the provider is established in the European Union, in the Federal Republic of Germany.

Point of contact for users (Art. 12 DSA)

Users can contact us via the same e-mail address as well as via the reporting and contact functions in the app. Communication expressly does not rely solely on automated tools: incoming messages are read and answered by a natural person.

Languages

The point of contact accepts communications in German and English and replies in those languages (Art. 11 (3) and Art. 12 (2) DSA). German is at the same time the language of the Member State of the main establishment.

Size of the provider

Zest UG (haftungsbeschränkt) is a micro enterprise within the meaning of Recommendation 2003/361/EC. The obligations of Section 3 of Chapter III DSA do not apply to it pursuant to Art. 19 (1) DSA; the obligations of Art. 11, 12, 14, 16 and 17 DSA are unaffected by this and are fulfilled by us. shiver is not a very large online platform within the meaning of Art. 33 DSA.

12. Supervision and dispute resolution under the DSA

The competent Digital Services Coordinator is the Bundesnetzagentur für Elektrizität, Gas, Telekommunikation, Post und Eisenbahnen, Tulpenfeld 4, 53113 Bonn. Complaints about compliance with the obligations under the DSA can be submitted there as well as to the European Commission.
